Agreement
These Terms of Service (“Terms”) govern your access to and use of BandFound at bandfound.com, including any related websites, apps, APIs, and features (the “Service”). By creating an account, signing in, or using the Service, you agree to these Terms and to our Privacy Policy.
If you do not agree, do not use BandFound. We may update these Terms from time to time. The “Last updated” date above will change when we do. Continued use after an update means you accept the revised Terms. For material changes we may also notify you by email or in-app notice.
The service
BandFound helps musicians share repertoire, find people nearby, form bands, post jams, connect with venues, message other members, and use members-only forums. Features may change, be limited by plan (including BandFound Pro), or be unavailable in some places.
BandFound is a connection tool. We do not employ musicians, book gigs, guarantee matches, verify every profile claim, or supervise in-person meetings. You decide whom you contact and whether to meet.
Eligibility
You must be at least 16 years old to use BandFound. By using the Service you confirm that you meet this age requirement and that you have the legal capacity to agree to these Terms. If you use BandFound on behalf of a venue, band, or other organization, you confirm you are authorized to bind that organization.
Accounts
You are responsible for:
- Providing accurate registration and profile information, and keeping it up to date
- Keeping your password and sign-in credentials confidential
- All activity that occurs under your account
- Notifying us promptly if you suspect unauthorized access
One person should use one account unless we expressly allow otherwise. Do not sell, rent, share, or transfer your account. We may refuse registration, reclaim usernames, or require verification when we reasonably believe an account is abusive, automated, or fraudulent.
Acceptable use
You may use BandFound only for lawful purposes and in line with these Terms. You agree not to do any of the following:
- Harass, threaten, stalk, intimidate, defame, dox, or otherwise abuse other people
- Post or send hate speech, content that promotes violence, or content that exploits or endangers minors
- Post sexual content involving anyone 17 or under, or any non-consensual intimate imagery
- Impersonate another person, band, venue, or BandFound; misrepresent your affiliation, age, identity, or location
- Spam, mass-message, advertise off-platform schemes, phish, or use messaging, forums, jam posts, listings, or profiles to blast links or solicitations
- Scrape, crawl, harvest, or use automated means (bots, scripts, spiders) to access, copy, or interact with the Service without our prior written permission — except ordinary use of a public search engine indexing publicly available pages
- Probe, scan, or test the vulnerability of our systems; circumvent rate limits, access controls, CAPTCHAs, or security features; or attempt unauthorized access to accounts, data, or infrastructure
- Introduce malware, viruses, or other harmful code; overload, flood, or disrupt the Service; or interfere with other users’ enjoyment of it
- Reverse engineer, decompile, or attempt to extract source code except where applicable law expressly allows it and you have first asked us for the information you need
- Upload content you do not have the right to share, including copyrighted setlists, recordings, photos, logos, or personal data of others without a lawful basis
- Use BandFound to commit fraud, money laundering, identity theft, or other illegal activity; or to buy, sell, or traffic illegal goods or services
- Create multiple accounts to evade bans, rate limits, referral rules, or other enforcement
- Collect personal data of other users for marketing, surveillance, or any purpose unrelated to genuine musical collaboration through BandFound
- Frame, mirror, or commercially redistribute the Service or our branding without permission
We may investigate suspected violations and cooperate with law enforcement when we believe it is necessary or legally required.
Your content
“User Content” means anything you submit, post, upload, or transmit through BandFound — including profiles, bios, songs and repertoire lists, playlists, band and venue listings, jam posts and photos, messages, forum threads and replies, reports, and other materials.
You retain ownership of your User Content. You are solely responsible for it, including its accuracy and for having all rights and permissions needed to post it.
By submitting User Content you grant BandFound a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt (for formatting and display), distribute, publicly display, and otherwise use that content solely to operate, improve, promote, and secure the Service. This license ends when you delete the content or your account, except that (a) copies may remain in backups for a reasonable period, (b) content you shared with others may remain visible to them as already delivered (for example messages already sent), and (c) we may retain limited records needed for safety, fraud prevention, or legal compliance.
You represent that your User Content does not infringe others’ rights and does not violate these Terms. Setlist photos, PDFs, and spreadsheets processed on your device are your responsibility; only the song rows you confirm are stored by us, and you remain responsible for rights in any source documents you import.
We do not claim ownership of song titles, artist names, or other repertoire metadata you list. Listing a song does not grant you performance, recording, or publishing rights beyond whatever rights you already have under law or license.
Our intellectual property
BandFound, including its software, design, text, logos, trademarks, and documentation, is owned by us or our licensors and protected by intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you. Do not use our name or marks in a way that suggests endorsement without our written permission.
Messaging, forums, and listings
Member forums are private to signed-in accounts. Do not use forums, chats, jam posts, band or venue listings, or profiles to spam, advertise unrelated products, dump links, or harass others. Treat private messages and group chats as personal communications — we may review them when investigating reports, abuse, or security issues, as described in our Privacy Policy.
Jam posts may include place names, directions, photos, and addresses you choose to share. Once posted, other users may see that information according to the post’s visibility. Think carefully before sharing a home address or other sensitive details.
Safety and in-person meetings
If you arrange jams, rehearsals, gigs, or other meetings with people you meet through BandFound, you do so at your own risk. Use common sense: meet in public or otherwise safe venues when appropriate, tell someone you trust where you are going, and leave if you feel unsafe. BandFound is not a party to your agreements with other users and is not responsible for their conduct online or offline.
Reporting, moderation, and enforcement
You can report jam posts, photos, chats, forum threads, profiles, and listings. We may (but are not obligated to) review reports, remove or restrict content, warn users, place accounts on hold, limit features, or suspend or permanently disable accounts.
We may take these steps with or without prior notice when we reasonably believe it is needed to protect the Service, other users, or to comply with law. Enforcement decisions are at our discretion. Blocking another user stops certain interactions between you; it does not guarantee they cannot create a new account or contact you elsewhere.
If your account is restricted and you believe that was a mistake, contact privacy@bandfound.com from the email on the account. We may decline to restore access for serious or repeated violations.
Copyright complaints
If you believe User Content on BandFound infringes your copyright, email privacy@bandfound.com with enough detail for us to locate the material (URL or description), a statement of your ownership or authority, your contact information, and a good-faith statement that the use is not authorized. We may remove or disable access to the material and, where appropriate, terminate repeat infringers’ accounts.
BandFound Pro and payments
BandFound Pro is an optional paid membership. On the website you pay with PayPal. In the Android app you pay through Google Play. In the iOS app you pay through the App Store. Store purchases follow that store’s billing, cancellation, and refund rules. Website PayPal purchases follow PayPal’s and our then-current checkout terms.
Prices and features may change. Taxes may apply. Unless required by law or by the applicable store, fees are non-refundable once the billing period starts. We may cancel or downgrade Pro for chargebacks, payment failure, fraud, or Terms violations. Paid status does not exempt you from these Terms or guarantee that content or accounts will remain available.
Referrals
Members may share a referral link. A new qualifying account created through that link may give the referrer a free month of Pro or other reward we describe at the time. We may withhold, reverse, or claw back referral rewards for self-referrals, fake accounts, spam, abuse, or other gaming of the program. Referral terms may change or end at any time.
Third-party services
The Service may link to or integrate with third parties such as Google or Apple sign-in, PayPal, Google Play, the App Store, Spotify playlist pages, map or geocoding providers, and email hosts. Their terms and privacy policies apply to their services. We are not responsible for third-party sites or services we do not control.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CONTENT (INCLUDING PROFILES, LISTINGS, AND MESSAGES) IS ACCURATE OR RELIABLE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BANDFOUND AND ITS OPERATORS, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR BANDFOUND PRO IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE PLACES OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
Indemnification
You agree to defend, indemnify, and hold harmless BandFound and its operators, affiliates, and personnel from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your User Content, your use of the Service, your meetings or dealings with other users, or your violation of these Terms or applicable law.
Termination
You may stop using BandFound at any time and may request account deletion as described in the Privacy Policy. We may suspend or terminate your access at any time if you violate these Terms, if required by law, or if we discontinue the Service. Upon termination, your right to use the Service ends. Sections that by nature should survive (including ownership, licenses already exercised, disclaimers, limits of liability, indemnity, and this survival language) will survive.
Export and sanctions
You may not use BandFound if you are prohibited from receiving services under applicable export control or sanctions laws, or if you are located in a jurisdiction where offering the Service would be unlawful.
General
These Terms are the entire agreement between you and us regarding the Service and replace any prior agreements on that subject. If a court finds a provision unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, sale, or reorganization. There are no third-party beneficiaries except as expressly stated.
These Terms are governed by the laws applicable where the operator of BandFound principally conducts business, without regard to conflict-of-law rules that would choose another jurisdiction, except where mandatory consumer protection laws in your country of residence require otherwise. Courts in that place will have exclusive jurisdiction over disputes, subject to those same mandatory protections.
